WAIVER / RELEASE AGREEMENT FORM

You, on behalf of yourself and any dependent(s), and guest represent and agree as follows: You understand that use of the Club's facilities, equipment, services, programs and premises includes an inherent risk of injury to persons and property. As such, you understand and voluntarily accept this risk and agree that PICKLEBALL XSCAPE will not be liable for any injury, including, without limitation, personal, bodily or mental injury, economic loss or any damage to you or any dependent(s), including those arising out of any active or passive negligent act or omission of the Club, except as to such which may arise from the gross negligence or willful misconduct of the Club.

You hereby agree that all exercises and use of Club facilities, equipment and services, programs or activities associated with the Club which are carried on anywhere, or while you are traveling to or from the Club are undertaken by you at your sole risk. If you have any special exercise requirements or limitations, you agree to disclose them to the Club before using the Club's facilities or when seeking help in establishing or carrying on an exercise program.

By your execution hereof, you hereby waive all claims which you or any dependent may have hereafter against the Club, and do hereby release the Club on your behalf and on behalf of any dependents, and agree to hold the Club absolutely harmless from all claims, demand, injuries, damages, actions, suits, or causes of action to persons or property arising out of or in any way connected with you or your dependent's use of the Club facilities.

You hereby agree any minors you bring into the facility is under your full responsibility and we are not liable for any injuries, lost stolen goods, and/or liable for any responsibilities for any minors.  

By signing this agreement, I (guest/member) agree to the terms above.

HOUSE RULES AND ETIQUETTE AGREEMENT

In order to maintain a safe, welcoming atmosphere at our club, we have expectations that must be adhered to. When signing this document, you acknowledge and agree to adhere to all policies outlined below and understand that failure to comply could ultimately result in expulsion from activities and/or the clubs.

• Kind & respectful behavior towards members and staff at the club is expected at all times
• Unsportsmanlike conduct and foul language will not be tolerated
• No outside food, drinks (besides water), gum, glass, or spitting on the courts is allowed
• Pickup after yourselves and throw away your trash in the designated areas.  Keep our courts clean
• Event rooms must clean after use. Throw away all trash into designated areas
• Appropriate clothing attire required on the courts
• Tennis/pickleball shoes are required to play on the courts.  No flip flops or open toe shoes on the court.
• Open play will be based on availability, but courts 1-4 will be primarily for open play. There is a 4 on 4 off rule for every court unless there is less than 4 waiting. Line up your paddle on outside of the courts on the fence to be next up
• If you would like to reserve a court, please speak to our staff member
• Balls machines, singles, or one on one drilling are only allowed with court reservation
• Speakers are allowed but only at a level that does not disturb other members. Please be mindful of your fellow members
• Only service animals are allowed. NO Pets
• House rules and etiquette will improve as Pickleball Xscape grows

Pickleball Xscape has a 3-strike policy in place for failure to comply with these that could result in expulsion from the club-run activities and/or the club. By signing below, I (guest/member) acknowledge and agree to these rules.
